Terms of Service

1. Acceptance of Terms

By accessing or using Flowcast ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. Flowcast provides WhatsApp automation, broadcast scheduling, and CRM synchronization tools for personal and business use.

2. WhatsApp Compliance and Account Risks

Flowcast is an independent automation tool and is not affiliated with, authorized by, or endorsed by WhatsApp LLC or Meta Platforms, Inc.

• User Responsibility: You are solely responsible for ensuring that your use of Flowcast complies with WhatsApp's own Terms of Service and acceptable use policies.
• Account Bans: While Flowcast provides safety features such as "Smart Pacing" and "Warm-Up Delays" to mimic human behavior, WhatsApp relies on strict anti-spam algorithms. Flowcast does not guarantee immunity from WhatsApp account bans, suspensions, or restrictions. You use this Service entirely at your own risk. We are not liable for any lost contacts, blocked numbers, or business interruptions.

3. Subscriptions and Limits

Flowcast operates on tiered subscription plans (e.g., Starter, Pro, Empire). Your access to features—such as the number of linked devices, Auto-Repost engines, and daily broadcast volume—is strictly limited by your active plan.

• Attempting to bypass system limits, reverse-engineer the API, or exploit bugs to exceed your plan's quota will result in immediate termination of your account without a refund.
• Subscription fees are billed in advance on a recurring cycle (monthly, quarterly, bi-annually, or yearly) and are non-refundable once the billing cycle has commenced.

4. Acceptable Use Policy

When using our Auto-Repost Engine, Broadcast Launchers, or Google Contacts sync features, you agree not to use Flowcast to:

• Send unsolicited spam, scam links, or malicious software.
• Scrape, steal, or distribute personal data from WhatsApp groups without consent.
• Promote illegal activities, hate speech, or explicit content.

We reserve the right to suspend or terminate your license immediately if we detect abusive behavior originating from your account.

5. Google API Integration

Flowcast offers a feature to synchronize WhatsApp leads directly to your Google Contacts. By enabling this feature, you grant Flowcast permission to manage your contacts via the Google API. Our use of your data is governed by our Privacy Policy. You are responsible for ensuring you have the legal right to collect and store the contact information of the leads you process through our system.

6. Limitation of Liability

To the maximum extent permitted by law, Flowcast, its creators, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of WhatsApp accounts, or business interruption resulting from your use of or inability to use the Service. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

7. Modifications to the Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We may also update these Terms from time to time. Continued use of the Service after any such changes shall constitute your consent to such changes.
